BoatyDo Terms of Use

Welcome to BoatyDo. By accessing or using the BoatyDo mobile application, website, or related services (collectively, the "Service"), you agree to be bound by these Terms of Use.

If you do not agree with these terms, you must not use the Service.

1. Overview

BoatyDo provides tools designed to help boaters:

  • Record and manage vessel issues ("BoatyDos")
  • Track maintenance and vessel history
  • Store photos, videos, and other media
  • Record and manage Points of Interest (POIs)
  • Interact with nearby boaters and service providers

BoatyDo is intended to assist with organization and communication related to boating activities.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use BoatyDo.

By registering for an account, you represent that:

  • You meet the eligibility requirements
  • The information you provide is accurate and current
  • You will keep your information updated

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately if you suspect unauthorized use of your account.

4. Your Content

You retain ownership of any content you submit through the Service, including:

  • Images and videos
  • Audio recordings
  • BoatyDos and vessel information
  • Points of Interest (POIs)
  • Messages and other user-generated content

You are solely responsible for all content you upload, post, or share through BoatyDo.

By submitting content, you grant BoatyDo a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, transmit, and display that content solely as necessary to operate, maintain, and improve the Service.

You agree not to upload or share content that is:

  • Illegal or unlawful
  • Abusive, threatening, or harassing
  • Pornographic or sexually explicit
  • Infringing on intellectual property rights
  • Harmful to others or to the Service infrastructure

BoatyDo may use automated tools and human review to detect or remove content that violates these rules. However, we do not guarantee that all prohibited content will be detected or removed.

5. Location Data

If enabled, BoatyDo may use your device's location services to:

  • Display your location to nearby users (when you choose to share it)
  • Suggest nearby boaters, providers, or points of interest

You may disable location services at any time through your device settings.

6. Rate Limits and Fair Use

To protect the stability of the Service:

  • Login attempts and location updates may be rate-limited
  • Automated or abusive use of the Service is prohibited

We reserve the right to suspend accounts that abuse the system or violate fair usage expectations.

7. Prohibited Activities

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code from the Service
  • Impersonate another person or misrepresent your identity
  • Use the Service for unauthorized commercial activities
  • Interfere with the security or operation of the Service
  • Use the Service in violation of any applicable laws

8. Third-Party Providers and User Interactions

The Service may allow you to discover or interact with other users, service providers, marinas, mechanics, or other third parties.

BoatyDo does not endorse, verify, guarantee, or assume responsibility for any third party, their qualifications, their services, or their conduct.

Any agreements, transactions, or disputes between you and a third party are solely between you and that third party.

9. No Navigation or Professional Advice

BoatyDo is provided for informational and organizational purposes only.

The Service is not a navigation system and does not provide professional marine, mechanical, legal, emergency, or safety advice.

You are solely responsible for the safe operation, navigation, and maintenance of your vessel and for the safety of your passengers and crew.

Always rely on appropriate charts, instruments, safety equipment, and qualified professionals where necessary.

10. Termination

We reserve the right to suspend or terminate your access to the Service if:

  • You violate these Terms
  • Your use of the Service harms other users or the platform
  • Your activity creates security or legal risks

11. Account Deletion

You may request deletion of your account using the features provided within the app or by contacting support.

We may retain certain information where necessary for legal compliance, fraud prevention, dispute resolution, or system integrity.

12. Intellectual Property

The BoatyDo Service, including its software, design, text, graphics, logos, trademarks, and related content, is owned by BoatyDo or its licensors and is protected by applicable intellectual property laws.

These Terms do not grant you ownership rights to the Service.

13. Warranty Disclaimer

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, BoatyDo disclaims all warranties, express or implied, including warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Accuracy or reliability
  • Availability or uninterrupted service
  • Non-infringement

14. Limitation of Liability

To the maximum extent permitted by law, BoatyDo shall not be liable for:

  • User-generated content
  • Interactions with other users or providers
  • Service interruptions or loss of data
  • Indirect, incidental, or consequential damages

15. Indemnification

You agree to defend, indemnify, and hold harmless BoatyDo and its owners, affiliates, and service providers from any claims, damages, losses, or expenses arising out of:

  • Your use of the Service
  • Your content
  • Your violation of these Terms
  • Your violation of any law or third-party rights

16. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time without notice.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts located in Florida.

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
